File №  2026-09/PROVO State of Utah v. Tyler Robinson Fourth District Court Updated

The
Ruling.

Six weeks in which a judge sent the case to trial, the widow put the university on notice, the two loudest accounts of the killing finally met in one room, and the first anniversary came and went with the roof still unexplained.

Every factual claim below is marked with how well it is actually proven. One standard, applied in both directions: where the State or the organisation overstated, we say so; where the skeptics overstated, we say so, including on points this site has carried. Where a claim could not be verified against a record we could open, it is marked as a failed or pending check rather than quietly dropped.

The case is going to trial. Nothing about guilt has been decided.

On September 1 the court found probable cause on all seven counts and a not-guilty plea was entered. That is the lowest bar in the system: a reasonable belief, on the State's evidence, that the defendant did it. The judge himself called one defense argument "substantial" and said it "remains for trial." The next date is a pretrial conference on October 23, where a trial date is expected to be set. The State still seeks death. Anyone telling you the ruling proved guilt, or that the case is collapsing, is describing a ruling that does not exist.

This page makes 0 factual claims. None are documented.

Before any argument, the shape of the evidence. Every claim in the ledger below is graded by how well it is supported, and the grades are counted from the page itself, so this bar cannot drift from what it describes.

  • 0 DocumentedA primary record exists that you can open yourself.
  • 0 On the record, via broadcastA real statement, ruling or exhibit, reaching you through someone's edit.
  • 0 AllegedA named source asserts it; the proof is not public.
  • 0 OpenCirculating and unresolved. Available material won't settle it.
Strip out everything that is not nailed down and both stories shrink. What is left of the official account is a bindover and a plea. What is left of the counter-narrative is a chain-of-custody gap, an unexplained DNA ranking, and a text nobody will vouch for.

Before judging either side, read the version its own advocates would sign.

Knocking down a weak version of an argument proves nothing. Both columns are built only from material that is documented or on the record — no theories, no anonymous sources, no assumptions of bad faith in either direction. Both have changed since July.

The State, the organisation, and their defenders

A case that survived its first test, and a security failure someone is finally being made to answer for.

  • The bindover. A judge who took twenty-four pages of notes found probable cause on every count after two hours a side, and the defense's own written brief did not dispute that the defendant fired the shot or that the messages are his. The defense's fight is about the death penalty and the standard of proof.
  • "It was me." Put on screen at the debate, from the hearing record: the defendant telling his roommate to look at the surveillance footage because it was him. The counter-narrative's answer is authorship, and it has produced no evidence of another author.
  • The ballistics answer. A soft-point .30-06 fragments on bone; the medical-examiner summary describes fragments; the absence of an exit wound is the expected outcome, not an anomaly. This went unrebutted on air.
  • Discovery. 12.1 terabytes and more than a million messages have gone to the defense, per the co-host's post. Whatever the device data shows, the defense now has it.
  • The concessions. The counter-narrative's leading voice withdrew the roommate-DNA claim, narrowed "complicit" to "believes he did it," said she has never accused the widow or the organisation of participation, and conceded she has no direct proof of a foreign hand.
  • The family's filing. Whatever else it is, the notice of claim is the victim's own family saying on paper that the roof was unwatched, the officers too few, and no ambulance present. That is the security-failure account, from the people with the most standing to make it.
  • The threats. The 1,034 documented threats against the widow remain the strongest fact against the movement built around the case, and nothing since July has displaced it.

Filed September 1: "an important step in our family's pursuit of justice."

The case for doubt

A bindover is a low bar, the record still has holes in it, and the organisation's own story keeps changing.

  • The standard. "Because the court may not choose between reasonable competing inferences at this preliminary stage, probable cause supports count six." The judge said the defense's argument on the capital aggravator was "substantial." Nothing about guilt was decided; the State's advocates have said otherwise.
  • The DNA ranking. Five or more profiles on the trigger of the defendant's own family rifle, his the most degraded, his father named. The State's defender in the debate conceded he had no explanation. It does not date anything; it is also not nothing.
  • The card. By the State's own agent, the rear camera's SD card never reached investigators: a flash drive and download links did, copied on the staffer's laptop within minutes. Three different reasons for taking the card down are now on the record from the organisation's side. Defense counsel said in court the State does not know whether the footage was edited.
  • The message nobody will own. A screenshot published by a third party, with timestamps that fall during a Zoom call with Israeli officials, contradicting the widow's December denial that any such message existed. The organisation that supplied it has not confirmed it.
  • Two rides, still. The pastor and the security lead in the same SUV still give incompatible accounts of the ride, and the pastor's has narrowed four times. The lead said Kirk had no fears the night before; the organisation's release says he did.
  • One decision, two owners. The organisation defended the no-ambulance decision as its own in November 2025 and its chapter answered "No" to EMS on the university's form; the family now pleads the same absence as the university's negligence.
  • The carried-forward gaps. Twenty-one unsecured minutes on the roof; a body camera that stopped; DNA-suitable items never compared; an autopsy admitted without its author. None of it has been answered since July.

None of this, on documented evidence alone, is a second shooter, a planted weapon, or a foreign hand. It is a record with holes in it and an organisation whose account of the day has not held still.

The evidence, item by item.

Six items. Each separates what is established from what is merely claimed, and ends with the one document that would move it. Filter the rows and watch how much of any story survives when you strip out everything that isn't nailed down: the counter-narrative and the official account both shrink.

The ruling

What the court actually decided on September 1, what it pointedly did not, and what each side argued when it finally had to argue in front of a judge rather than a camera.

Documented
After two hours a side, Judge Tony Graf found probable cause on all seven counts: aggravated murder, felony discharge of a firearm causing serious bodily injury, two counts of witness tampering, two of obstruction of justice, and a Class A misdemeanor for a violent offense in the presence of a child. The standard was probable cause: a reasonable belief on the State's evidence, with inferences drawn in the State's favour. Not guilt, not beyond reasonable doubt. The judge said he took "24 pages worth of notes" and reviewed them in recess before ruling.Utah R. Crim. P. 7B; Deseret News, Sep 1 2026

What the defense argued: one shot was fired and one person hit, and a bolt-action rifle is not a device "more likely to cause injury to multiple people" (Staci Visser); the political-targeting motive is "an inference without evidence, and it's a very inflammatory inference," resting on the roommate relationship and a single text (Richard Novak). What the defense did not argue, in any account of the hearing we could open: a second shooter, a planted weapon, an alternative suspect, or a frame-up.Oral argument, Sep 1 2026 · KUER, Deseret News, NBC News

The defense's own written brief, filed August 12, argued that the State's case "consisting primarily of hearsay that has not been assessed for reliability" should not support bindover, that the State made "little effort to distinguish between the evidence it presented and inferences it asks this court to make," and that "the firing of a single shot at an intended victim that hit only the intended victim" is not an aggravator "merely because other people were in the vicinity." What the brief did not do: dispute that Robinson fired the shot, or challenge the authenticity of the messages. The defense's fight, on paper, is about the death penalty and the standard of proof, not about a different shooter.Defense bindover brief, Aug 12 2026 · Deseret News, KSL, Fox News

What the State argued: "You can't shoot a rifle into a crowd of 3,000 people without knowing that you create a great risk of death to all those around your target"; the scope "likely passed over the faces and heads and bodies of multiple people before it rested on Charlie Kirk" (Deputy County Attorney Ryan McBride). The court's reasoning on the witness-tampering count, played as audio: advising someone to ask for a lawyer and stay silent "is lawful and does not establish witness tampering"; the State relies on the context, including an earlier alleged instruction to "delete this exchange"; and "because the court may not choose between reasonable competing inferences at this preliminary stage, probable cause supports count six." That sentence is the whole bindover standard in one line, and it is why "the judge believed the State" and "the judge threw out the defense" are both wrong descriptions of September 1.Ruling audio as played on the Owens broadcast, Sep 2 2026 (Ep 382)

Novak's oral argument on motive, as played: Kirk "spoke hatefully" of people outside traditional gender and sexual norms, and the roommate's relationship with the defendant is real, but "that doesn't mean that those personal choices… equate with the hate that at least Mr. Robinson says he had toward Mr. Kirk… And that's an inference without evidence." Within hours it was circulating as a lawyer "justifying political assassination." The show's co-host posted that the defense has received 12.1 terabytes of discovery and more than a million Discord messages. Two broadcast claims about the ruling failed. That "never in the history of Utah" has someone been convicted of aggravated murder for one victim and one bullet is contradicted by Utah's own capital record (Honie, executed 2024; Gardner, 2010). And the prediction that the aggravated-murder count would not survive was wrong the next day; the miss was not revisited. The narrower point survives: whether a single aimed shot "knowingly created a great risk of death" to others is, in the judge's own word, "substantial," and it is for trial.Owens broadcasts, Sep 1–2 2026 (Eps 381–382); Utah Department of Corrections records

What the not-guilty plea means. Nothing, in either direction: it is the near-universal plea at arraignment in a capital case and is not evidence about the "father turned him in" account, which itself rests on an officer's summary rather than any parental statement produced at the hearing. Both sides have tried to make the plea carry weight it cannot.Arraignment audio, Sep 1 2026; charging document

The notice of claim

The victim's own family has now put in writing, under a statute, several of the things this site has been asking about for a year. That is worth exactly what it is worth, and no more.

Documented
On September 9, 2026 the firm Parkinson Benson Potter filed a notice of claim for Kirk's heirs, the statutory precondition to suing a Utah government body. It names Utah Valley University, the State of Utah, the UVU Police Department and its chief Jeffrey Long, former president Astrid Tuminez, and unnamed state actors. No dollar figure; damages are called "substantial." Suit must follow within two years of the death.Notice of claim, Sep 9 2026 · Deseret News, KSL, CNN, Daily Herald, Sep 16

The allegations: rooftops overlooking the amphitheater went unsecured and unmonitored despite assurances; no officers were posted on roofs and no one watched the roof cameras live; no drone; six officers (about a quarter of the campus force) after a request for more was declined by the president; no help sought from neighbouring departments; no written security plan and no pre-event briefing; roof access easy and well known to students.Notice of claim as described by Deseret News, KSL, KUTV, Sep 16 2026

The filing quotes a text in which the police chief answered a rooftop-security concern with "I got you covered." It also alleges no ambulance was on scene, and that Kirk was taken to Timpanogos Regional Hospital in a private vehicle. The absence of an ambulance was a "conspiracy" question in September 2025; it is now a paragraph in the victim's family's legal filing.Notice of claim · Deseret News, Western Journal, KUTV, Sep 16 2026

Independent of the family: UVU's own planning records, released to ABC News under a records request in November 2025, show the event questionnaire answered "No" to "Will EMS need to be scheduled?", the approval committee noting that a first-aid station and extra insurance were not needed, an attendance estimate revised from 200 to 600 against more than 3,000 who came, two campus EMTs on site with no ambulance, and six officers working the event. Who made the medical call. In November 2025 a Turning Point official told ABC News there was no ambulance because the organisation had "staffed up" to twelve security operators carrying medical kits, and UVU's form shows it was the TPUSA campus chapter that answered "No" to scheduling EMS. The family's notice now pleads the absence of an ambulance as the university's negligence. The university's own review is still unpublished. UVU announced an independent review on September 22, 2025; it was to conclude by late spring 2026; by May it had cost more than $242,000; on September 12, 2026 the president said findings would come "later this month." As of this page's date nothing has been released. A broadcast claim that the review was due September 18 and would be "devastating" to Turning Point's security is therefore pending, not confirmed: the date passed without a release, and the characterisation is a single source's.Utah News Dispatch, Sep 22 2025; Salt Lake Tribune, Sep 9 2026; KSL, Sep 12 2026

That the family's filing quotes the police chief's text thread selectively, omitting a line in which the security lead says he was told students had access to the area above; that a Turning Point events lead insisted on the amphitheatre over the university's traffic-control warning in an August 25, 2025 planning meeting; and that the filing acknowledges Kirk told his security the night before that he feared being killed. The first was shown as a side-by-side on air and is checkable against the filing; the second is a single unnamed source; the third would be significant and is checkable the moment the notice is obtained.Owens broadcast, Sep 16 2026 (Ep 388) · notice of claim (not yet obtained by this site)

Why now. One broadcast reading is that the filing is a pre-emptive strike ahead of the university review and was pushed by Kirk's parents rather than his widow. The debate

On August 14 the counter-narrative and the official account argued for three hours in one room, with documents on screen and fact-checkers for both sides. It is the only place all year where each side's case was tested by an adversary in real time. Here is what survived.

Documented
Candace Owens and Andrew Wilson debated on the PBD Podcast, moderated by Patrick Bet-David, for three hours and eleven minutes, each with three fact-checkers able to put documents on screen. The propositions were symmetric: overwhelming evidence Robinson did it against overwhelming evidence he was a patsy. Wilson put his own confidence at 75–85%; Owens put Robinson's chance of being the shooter at zero while saying he "was involved that day."PBD Podcast, Aug 14 2026 (full video public)

Wilson's best evidentiary item: a message from the hearing record in which Robinson tells his roommate "It was me. Look at the pictures from the surveillance footage. It was me." Owens said she did not remember it and asked for a fact-check; the screen showed it; she accepted it. Her "never set foot on campus" claim now has to run through the authorship of the messages, not around the footage.Hearing exhibit as displayed on air, 00:43–00:47

Wilson's second: a 150-grain soft-point .30-06 round fragments on bone, so the absence of an exit wound is the ordinary expectation, and the medical-examiner summary read on screen describes fragments. Owens did not answer it beyond "not disputing a projectile." It is the standard reply to the "Superman neck" argument and it went unrebutted.ME summary as read on air, 00:17–00:18; standard terminal ballistics

Owens' best: the State's own forensic testimony that the trigger carried a mixture of five or more profiles and that Robinson's was the most degraded, on his own family's rifle, with his father explicitly named as a contributor. Wilson granted it for argument, asked "so what," and, pressed, said he had no explanation. It is a genuine open item. It is also not a clock: degradation cannot date a deposit, and a shared heirloom carrying relatives' DNA has innocent readings.Oliver / Carner testimony as cited on air, 00:19–00:28

Three on-record narrowings by Owens. She withdrew the claim that the roommate's DNA was on the rifle ("wrongly extrapolated"; only the father was named). She said she has never claimed Erika Kirk or Turning Point participated in the murder. And "complicit" was reduced, under questioning, to "she believes Robinson did it" — "That's it." Three on-record failures by Wilson. He said "this never happened" of his own tweet calling the car, the stairwell images and the roof DNA "overwhelming, man"; the fact-checkers displayed it. He could not name the charges (he said "murder"; Owens listed all seven, confirmed on screen). And he insinuated Owens was being fed questions by text; she handed her phone to the moderator, who read it and found nothing.Debate, 00:36–00:41, 02:43–02:50

Wilson opened by reading a September 9, 2025 exchange he said Turning Point gave him: Kirk's security lead reporting a law-enforcement-approved plan, campus police cover and "I have 11 on site," and Kirk replying to remind them they were there for one person's security "because I'm somewhat worried the left is trying to kill me." He would not show it on air; on about August 23 he published screenshots on his own programme, with timestamps. The organisation that supplied it has not publicly vouched for it. The host disputes it on three grounds: that her own source in September 2025 was the organisation's spokesman, who described the message to her without the words "the left"; that a second source says it went by iMessage, not Telegram; and that the timestamps place the messages during Kirk's Zoom call with two Israeli officials, two hours after his text leaving the pro-Israel cause. If authentic it cuts two ways at once: against a foreign-hand motive and toward the security-posture question in the notice of claim. It also contradicts the widow's December 2025 statement that no such message existed. The custodian could settle it in a sentence and has not.Read on air Aug 14; screenshots published c. The discovery dispute, reconciled on air. Defense counsel Kathy Nester said in court she had not been given access to her client's phone; the prosecution's Rule 16 statement says everything "presently and reasonably available" was disclosed by April 1. Both are true: the State disclosed what it held, the federal agencies held the device data, and the judge deferred it. Authorship of the messages was therefore not tested at the hearing, which is the honest version of both sides' claims.Nester clip and Rule 16 filing as displayed, 01:01, 01:21

Owens' France claim rests on a source she describes as high in the French government who told her the Foreign Legion was on the ground on September 10, which she says she reported in writing to the Director of National Intelligence's office, the President's office and Dan Bongino. Asked repeatedly for positive evidence for Israel or France she offered none beyond the filed report, and retreated from "full confidence" to "I'm allowed to think it."Debate, 01:40–01:56

The Panguitch steakhouse stop, which supplies five to six hours of Owens' timeline for Robinson's evening, rests on an owner's word, a server interview and a redacted receipt; no camera and no card match. Owens called it unverified, kept it, and said she would remove it if debunked. Wilson's point that a merchant lookup of the card would settle it is correct and remains undone.Debate, 02:49–02:58

The explosive theory, which Owens now holds as "a possibility" rather than a belief. Wilson's rebuttal that a passing bullet's air displacement moves fabric is muzzle-blast physics misapplied, and he contradicted himself five minutes later by saying he could not see the shirt move at all. Owens' rebuttal that 1,500–2,000 "pounds of energy" should have thrown Kirk backward is the same physics error this site has flagged three times: muzzle energy is not a force on the body, and a bullet's momentum cannot throw a person. Only the front-facing camera footage would settle what the shirt did.Debate, 02:18–02:30

The footage, the card, and the file

Six weeks of "never before seen" clips. Most of them show what the sworn record already said; one of them, if its provenance holds, would matter. Here is which is which.

On the record, via broadcast
The chain of custody for the rear-facing camera, from the hearing: the staffer who removed its SD card gave investigators a flash drive the same afternoon and, later that day, download links to four files; the card itself was never handed over. His sworn statement, collected on May 6, 2026, lists three angles and four files and separately authenticates a short rear-camera clip. Read the hearing testimony and the fact that the footage reached investigators through his own laptop is not a discovery; it is the record.Agent Hull testimony and the Rule 1102 statement, as read on air Aug 18–21 2026 (Eps 377–379)

Three tent clips, never previously public, described as coming from a government source: the staffer pocketing the card and texting; opening a laptop and appearing to insert it about ten minutes after the shot; showing the screen to the microphone technician. On their face they show a man copying a card. That is exactly the step the sworn account requires. They confirm the custody gap and show nothing about alteration. Their provenance is unstated.Owens broadcasts, Aug 18–21 2026

Why the card came down at all. Three explanations are on the record from the organisation's side: officers asked the crew to turn cards over before lockdown (a Turning Point executive's post); the staffer did it on his own to spare the widow another angle (what he told the host, by her account); and "people can be evil," hats were stolen (its spokesman, to Carlson). One card, three stories. Confusion explains it as well as anything worse, and nobody has produced the instructing officer.Bowyer post, Oct 2025; Kolvet on Carlson; Owens' account of her call

The host declined, on air, to call the staffer's conduct a crime, and read Utah's tampering statute correctly: it requires a purpose to impair the evidence's availability or veracity, which same-day copies to police fit poorly. Who made the courtroom compilation: the agent testified it was prepared by the Utah County Attorney's Office, with a sergeant collecting the campus surveillance. Not the court, not the FBI. The claim that the compilation's aspect ratio was squeezed, slimming the figure on the stairs, rests on an unnamed government source and the host's own "restored" version, whose parameters were not stated. A horizontal squeeze distorts everything in frame equally, so the cars would show it, and the native exhibit is in the defense's hands.Hull testimony as read on air; Owens broadcast, Aug 21 2026

"Uncompressed 4K stills" of the parking-garage figure, said to show a broader build, high white socks and a phone taken from the left pocket. Provenance unstated on both sides: the host's frames are unshown in origin, and the accusation that they were AI-enhanced was itself posted without evidence and community-noted. The ride, the hospital, and the scrubs

The one thread where two of the organisation's own witnesses still contradict each other on the record, and where the newest footage raises a question with several ordinary answers and no official one.

On the record, via broadcast
The CPR contradiction has not closed; it has narrowed on one side only. The pastor who rode in the cargo area has moved across four statements from "giving him CPR" to "sometimes doing CPR" to "the last thirty seconds" to, on September 10 this year, an "irrelevant detail" with "no bearing on who killed Charlie" and "Brian is generally right." The security lead's account, given in November 2025, has not moved: no CPR, stopping the bleeding. Two men in one small vehicle still describe two different rides. Footage said to show the security team returning to the campus after 8:30 p.m. on September 10 in hospital scrubs, including a member who, on the public footage, never touched Kirk, never rode in the SUV, and is seen afterwards with a clean shirt. The question, "when and where did he put them on, and why," is fair. The answers on offer, that the team went to the hospital later and were given scrubs there, are ordinary, and the host herself allowed it. Nobody from the organisation or the hospital has said which.Owens broadcast, Sep 9 2026 (Ep 385); footage provenance unstated
Alleged
A man eating lunch in the hospital car park described, in a video posted in September 2025, "some dude" in a white hat climbing out of the SUV's rear hatch and a bald driver getting out. It is one bystander's account, but it is a contemporaneous one, and it is checkable against the hospital's exterior cameras, which a warrant already covers.Bystander video, Sept 2025, replayed Sep 9 2026; Utah Valley / Timpanogos surveillance warrant, Sep 10 2025
Alleged
That a hospital doctor who worked on Kirk asked to be removed from every record connected to September 10 after a disagreement during or after surgery; that a nurse said a chest saw was requested. Unnamed, unverified, and offered as "just putting that out there." Recorded here at the grade it was offered.Owens broadcasts, Sep 9 and 14 2026

The chief of staff's whereabouts after the shot are now on video: about twenty-five minutes later, still on campus, giving a recorded statement to an officer wearing a task-force vest, after ending a call. The organisation's public account had him "walking away" per protocol, making calls, and later at a hotel. Nothing in the footage contradicts that account; it fixes him on campus rather than in the vehicle, which is where the account already had him.On-scene footage published Sep 15 2026 (Ep 387); Turek and Rob McCoy accounts, Sept–Oct 2025

The vehicle question, as far as it goes: two members of the detail who did not arrive in Kirk's SUV opened its passenger door within seconds of the shot; a member fell out of the tailgate trying to climb in and a backpack fell with him, picked up by a long-time logistics staffer; the SUV's driver had gone upstairs with an assistant minutes before the shot. All of it is on footage. The inference built on it, that the vehicle was "locked on arrival" and someone had keys they should not have, has no source. Keys staying with a protective vehicle is standard practice.Departure footage as reviewed Sep 2–4 2026 (Eps 382–383)

Whether the medical decision on the day, private vehicle rather than ambulance, cost anything. The family's filing now says the absence of an ambulance was negligence; the organisation said in November 2025 its own twelve-person team was the plan; the hospital was minutes away. This is now a question in a legal proceeding rather than a podcast, which is the first time it has been anywhere that can compel an answer.Notice of claim, Sep 9 2026; ABC News, Nov 18 2025

Turning Point, one year on

The organisation at the centre of the counter-narrative had a year of growth, a memorial on the campus it is now preparing to sue, a schools programme drawing new fire, and a public split with the broadcaster who was once its founder's closest ally.

On September 17 Erika Kirk addressed students at Nampa Christian School in Idaho during a school-day assembly. Turning Point posted "500 plus" attendees. Its spokesman, in a public exchange, confirmed the assembly format, said students were "free to opt out. Alleged
That the school's newsletter barred parents from attending and that a student texted that they could not leave. Anonymous, relayed on air; the assembly and the three opt-outs are confirmed by the spokesman himself, the compulsion is not.Owens broadcast, Sep 18 2026 (Ep 389)

Against the assembly model, a clip of Charlie Kirk at Aspen describing Club America as an opt-in chapter students start themselves, "built in" like DECA, with staff meeting parents and administrators. Both things can be true: the founder described a chapter model, and the organisation is now also doing assemblies. Politico's September profile of the show's co-host Blake Neff quotes him: "Either we have to make our peace with censorship and explain how we're going to do that, or we have to explain how we're going to combat this without censorship." A November 2019 text thread, shown on air from the host's own phone, in which the same spokesman forwards her a 4chan post plotting a Kirk–Owens feud, attributes it to online trolls and notes Kirk's then-girlfriend had found it. The screenshots are a document; the inference now drawn from them, that the feud was seeded from inside, is speculation. The thread does sit awkwardly beside the spokesman's current account that the two were not friends after 2018: the founder and his future wife attended Owens' wedding in August 2019.Screenshots displayed Sep 18 2026; wedding attendance is public record

In a Deseret News piece on the anniversary, the show's co-host recalled sitting in the hospital waiting room on September 10 as someone said "Candace is gonna have an extreme reaction to this," and agreeing. One broadcast read that as foreknowledge. The article supplies the ordinary reading in the same paragraph: the founder knew her theories and the organisation had distanced itself from her in 2024, so the reaction was predictable. The same co-host also said "those of us who knew Charlie best, a group that doesn't include Tucker, do think that Tyler Robinson did it," which is a documented statement of belief and nothing more.Deseret News, Sep 7 2026

On the anniversary the organisation held its memorial on the UVU campus, with its spokesman telling the crowd "we did not come back to rehearse a crime scene," one day after the family signed its notice of claim against that same campus, a filing made public the following week. The Network Contagion Research Institute's July finding of 1,034 explicit threats against Erika Kirk remains the strongest documented fact cutting against the movement built around this story, and nothing in the six weeks since has displaced it. It belongs in the same ledger as everything above.networkcontagion.us, Jul 2026

Settles itNothing here is a murder question. The checkable items are the school's own communications for the Idaho assembly, the full Carlson segment, and the original 2019 thread, which its owner could publish in full.

Where the checks cut against each side.

The same tests, run in both directions. A page that only catches one side out is a brief, not an audit.

Against the counter-narrative

Eight claims that failed, narrowed, or were withdrawn on check.

  • The roommate's DNA on the rifle. Asserted in August as the strongest evidence against a second man; withdrawn on air two weeks later: "wrongly extrapolated." Only the defendant's father was named on the stand. The towel, screwdriver and Dremel items are unaffected, but the headline claim is gone.
  • "Complicit." Under questioning, "impossible to think Erika Kirk is not complicit somehow" became "she believes Robinson did it. That's it." That is a different sentence, and the page records the narrower one.
  • Israel and France. Asked repeatedly for positive evidence, the answer was a filed report about an unnamed source and "I'm allowed to think it." A concession that there is no direct proof is a concession; it was headlined as one by outlets on both sides.
  • The recoil argument, fourth time. "Two thousand pounds of energy and he didn't go backwards" is not physics. Muzzle energy in foot-pounds is not a force on a body; a bullet's momentum cannot throw a person, or the shooter would be thrown too. It has now been made on four broadcasts and corrected on none.
  • The steakhouse receipt. Five to six hours of the counter-timeline rest on an owner's word and a redacted receipt. Its proponent called it unverified and kept it. One merchant lookup would end the argument either way, and nobody has done it.
  • "Rot." The word in the episode title is not in the clip that aired. Carlson's break with the show's co-host over censorship is real and worth reporting; putting a word in his mouth to sharpen it is the one-word upgrade this page flags whoever does it.
  • "Why now." The notice of claim was read as a pre-emptive strike timed to a damaging university review. The statute gives one year to file such a notice; the year ended on the anniversary. The mundane explanation needs no source. The dramatic one has not produced its source, and the review it predicted for September 18 has not appeared.
  • "Conspiracy theory was invented by the CIA." False as stated. The phrase is decades older than 1963; the real document is a 1967 dispatch about discrediting Warren Commission critics. A true fact was upgraded into a false one.

And the tell: the argument that "the entire hearing was hearsay" became "the overwhelming majority" once the rule was read aloud. Narrowing under pressure is honest. Starting wide every time is a pattern.

Against the official account and its defenders

Eight moves that overstate, withhold, or contradict the record.

  • "This never happened." The debater defending the State's case denied his own tweet listing the car, the stairwell and the roof DNA as "overwhelming, man." It was put on screen. He then could not name any of the seven charges he was defending, and insinuated his opponent was being fed answers by text; her phone was read on air and was clean.
  • Documents for thee. The same debater demanded documents on screen for every claim against him and, on the one document he brought, the September 9 texts, declined to show it: "I want to drip out the evidence." Five weeks later it is still unpublished.
  • Two owners of one decision. In November 2025 a Turning Point official defended the absence of an ambulance as covered by its twelve-person team, and the university's form shows the organisation's own chapter answered "No" to scheduling EMS. In September 2026 the family's filing pleads the absence of an ambulance as the university's negligence. Both documents are real. They cannot both be the whole story.
  • The memorial and the lawsuit. The organisation held its anniversary event on the campus it had, the day before, formally notified of intent to sue for the founder's death. That is a fact, not an accusation, and it deserves an explanation nobody has offered.
  • "Nobody questioned the messages." The defense asked for the phone and the device data before the hearing and did not get them; the judge deferred it. Authorship was not tested because it could not be, which is not the same as nobody asking.
  • "Mountain of evidence." The phrase is the prosecutor's. The judge's finding was "sufficient at this stage to support a reasonable belief," and on the capital aggravator he called the defense's argument "substantial." Reporting the first as if it were the second is an upgrade.
  • The 2019 thread. A spokesman who now says the founder "feared" the host after 2018 is shown, in his own 2019 messages, forwarding her a troll post plotting a feud between them and warning her about it. The screenshots are one person's; the contradiction, if they are authentic, is his.
  • "Free to opt out. Three did." A school assembly during the school day, unadvertised "for security reasons," is what the organisation's own spokesman described. Calling 500 attendees at an assembly a "tour stop" of a club is marketing, and the spokesman's own replies confirmed the format his critics alleged.

And the structural one: the courthouse chorus that promised "crystal clear 4K" of a face and a plate in July has still not been asked to reconcile that with the sworn "there is not, judge." Accounts that never retract are not thereby more accurate.

Credit where the record earns it.

Symmetry is not only for catching people out. In these six weeks the show driving the counter-narrative withdrew its own DNA claim on air, said plainly that it has never accused the widow or the organisation of taking part in the killing, conceded it has no direct proof of a foreign hand, declined to call the vandalism of the founder's statue a hoax, and put a debate on the record in which its case was cross-examined for ninety minutes with documents on screen. On the other side, the defense's own brief conceded the shot and the messages, the organisation's spokesman answered a critic point by point in public rather than by silence, and a formerly allied broadcaster rebutted the show's co-host by name on principle. People on both sides said things against their interest. That is what a live inquiry looks like, and it is more than most of the year produced.

The tell to watch for, in anyone.

"Notice the pattern", where every new fact confirms the conclusion, and "anyone still asking is a ghoul", where every question is bad faith, are the same move in different clothes: a framework in which no observation could count against it. Ask of any claim on this page, including ours: what would I expect to see if this were false, and have I looked? If nothing would look different, you are holding a belief, not an argument.

Open questions, and the exact record that closes each.

Every row names a record that already exists. Several are new since the hearing; several are carried forward because nobody has produced them. A question that cannot be paired with a retrievable document is usually not a question. It is a mood.

Open questionThe record that settles it
01Are the "uncompressed 4K stills" of the parking-garage figure genuine frames, and is the courtroom reel squeezed or merely compressed? The original camera export, with its aspect ratio; cars in frame make a squeeze measurable
02Is the phone in the stairwell footage in a left or right hand? The unblurred 4K stairwell frame: one image settles it
03Who wrote and sent each message attributed to the defendant, and when?Device-level extraction with account, origin and per-message timestamps; Discord and Apple account logs
04Why is the defendant's profile the most degraded of five-plus on his own family's rifle? The full DNA quantitation report, not the summary testified to
05What exactly did Kirk and his security lead say to each other on September 9, 2025?The screenshot with metadata, held by Turning Point and promised by the debater who read it
06Did the widow have that message when she said on December 11, 2025 that no such message existed? The same screenshot, against the Glenn Beck broadcast of that date
07Was the defendant at the Panguitch steakhouse on the evening of September 10?A merchant lookup of the card on the receipt; the server's FBI interview, if one exists
08What does the family's notice of claim actually say, in full, about the roof text thread and the September 9 fear message? The notice of claim itself, a public record held by the Attorney General's office
09Who decided there would be no ambulance, and on what advice? The UVU event file (already partly released to ABC News) and the organisation's security plan
10What did the university's independent review find, and why is it a year late? The review report the president said would be released in September 2026
11Did the rear-camera SD card ever reach investigators, or only a flash drive and download links? The SBI evidence log for September 10 and the Rule 1102 statement of the staffer who held it
12Who took the chief of staff's witness statement on the day, and under what authority? The statement itself and the officer's assignment record
13What fell from George Zinn's leg during his arrest, and where is it now?The Utah County booking and property record for September 10, 2025
14Does body-camera footage exist of the officer the defendant's car "made contact with" during the manhunt? That officer's Axon record for the night of September 10–11
15Who was on the Losee roof in the 21 minutes before it was secured, and did the first officer's camera die or stop?Clearing officers' body cams; the Axon device audit trail (carried forward from the hearing)
16Who dialled 911, and is a call from the vehicle missing? The full dispatch/CAD log, 12:20–12:40 p.m., Sept 10 (carried forward)
17What did Carlson actually say about the show's co-host, in full? The complete segment, not the excerpt that aired elsewhere
18Were students at the Idaho assembly free to leave, and were parents told they could not attend? The school's newsletter and emails to parents for the week of September 14
19Is the 2019 text thread authentic and complete? The full thread export, which its owner could publish
20When will the case be tried? The minute entry of October 23, 2026

Bound over, not tried. Sued, not judged. Debated, not settled.

Alleged only

The uncompressed stills and the squeezed compilation. The three tent clips. The scrubs. The man in the rear hatch. The recused doctor. The Panguitch receipt. The Foreign Legion source. The "at war with me" thesis. The keys. The 2019 thread as proof of seeding. And, from the other side: the September 9 screenshot nobody will vouch for, "mountain of evidence," "crystal clear 4K," "nobody questioned the messages," "the left did it" as a settled motive. Every one rests on an anonymous source, a first-person account, a document someone else holds, or a phrase doing more work than its evidence. Unproven is not disproven, but it is also not proven, and the distance between those three words is where this entire story still lives.

Failed or withdrawn on check

The roommate's DNA on the rifle: withdrawn by its author. "Never in Utah history": contradicted by two executions. The count-one prediction: wrong the next day. "Conspiracy theory was invented by the CIA": false as stated. "Rot": not in the clip. The Sept 18 review release: did not happen. And on the other side, "this never happened": it did, on screen. Each is recorded here rather than quietly dropped, because a page that only publishes the checks that worked is not doing checks.

Do not take this page's word for it.

Everything here is assembled from public material. If you want to verify, correct, or demolish any of it, these are the actual doors.

The court file
Fourth District Court, Utah County, State of Utah v. Tyler James Robinson. The September 1 bindover ruling, the not-guilty plea, the October 23 pretrial conference and every filing in between are on the docket. The ruling is the controlling record for everything in the first ledger item.
The notice of claim
Filed with the State of Utah under the Governmental Immunity Act on September 9, 2026 by Parkinson Benson Potter on behalf of the Kirk heirs. It is a public document; the reporting quoted here (Deseret News, KSL, CNN, the Daily Herald) is a description of it, and the filing itself is the record.
The debate
The August 14 Owens–Wilson debate ran for over three hours on the PBD Podcast, moderated by Patrick Bet-David, and is available in full. Where this page cites a claim made in it, you can watch the person say it rather than trusting a summary, including ours.
