File № 2025-09-10/UVUState of Utah v. Tyler RobinsonUpdated
Against the Official Account.
Everything on the record that cuts against the story as it has been told: one young man, one shot, a confession, a family that turned him in, and a security plan that did its job.
Every item is graded by how well it is proven. What rests on sworn testimony, court filings or public records is kept apart from what rests on a single voice. Claims that have been withdrawn or have failed on check are not here at all.
Real holes in the record. No proof of a different shooter.
The documented items below show a probable-cause case whose forensic headlines were oversold, a scene and chain of custody with gaps, a motive the State has not proved, a security posture the victim's own family calls negligent, and accounts of the day that do not agree. They do not establish a second gunman, a planted weapon, or a foreign hand. The case was bound over on all seven counts on September 1 and has not been tried.
This page makes 0 factual claims. None are documented.
The grades are counted from the page itself, so this bar cannot drift from the ledger below.

The scene and the chain of custody
Where the investigation itself left gaps. Every row here comes from sworn testimony, the State's own witnesses, or people who did the work.
On the record
The roof was unsecured for about 21 minutes. Shot at 12:23; the first documenting officer arrived around 12:44, with other officers clearing the building in between. His body camera stopped mid-scene, he never reviewed footage of that window, and the armed plainclothes man who accompanied him has never been identified.Hearing testimony, July 2026 · Deseret News, KSL
On the record
Items on the flight route were collected, found suitable for DNA, and never compared. A backpack, jacket and gloves seized at library bus stops went to the FBI lab. Testing stopped after a note, written by no witness who testified, recorded that the backpack "belongs to Kirk's detailees."FBI examiner testimony, July 10 2026
On the record
An empty pistol holster in the courtyard was never taken into custody and may never have been fingerprinted. A live .223 round sat on a neighbouring roof. A contemporaneous police report described the car as driven by a bald man with three passengers, which surfaced only on cross-examination.Hearing cross-examination, July 2026
Documented
The ground-level scene was excavated and paved within days. The paving contractor says he was called for an "emergency" job with a Monday deadline; a second contractor says a government team had already removed about ten inches of soil. The courtyard was under federal control at the time.Paving contractors, on camera · scene-preservation analysis
On the record
The rear-facing camera's SD card never reached investigators. The State's agent testified the staffer who removed it gave police a flash drive and, later that day, download links from his own laptop. Defense counsel said in court the State does not know whether the footage was edited. Three different explanations for taking the card down are on the record from the organisation's side.Agent Hull testimony; Rule 1102 statement; Nester in court; Bowyer and Kolvet posts
On the record
There is no footage of the shot. Asked whether the State's compilation shows the shooting: "There is not, judge." The "enhanced" exhibit adds red circles and zoom. Descriptions of "crystal-clear 4K" of a face and plate went beyond the public exhibits.Hearing testimony, day 2
Settles itClearing officers' body cams and the Axon audit trail; the FBI lab log for the halted testing; the evidence log for the holster; the SBI evidence log for September 10; the paving work order.
The forensics, at their sworn limits
Not what the headlines said. What the State's own experts conceded under oath.
On the record
The trigger DNA is a degraded mixture of four to seven people. The State's forensic biologist agreed that a flat "his DNA is on this item" is "not scientifically defensible," that "major contributor" describes quantity rather than activity, and that DNA transfers secondhand.Caitlin Oliver testimony · PBS NewsHour, Deseret News
On the record
The defendant's profile was the most degraded of five or more on his own family's heirloom rifle, and his father was named as a contributor. The debater defending the State's case, asked to explain it, said he could not.Hearing testimony as cited in the Aug 14 2026 debate
Documented
The ballistics are inconclusive. The examiner could neither identify nor exclude the recovered rifle from the one usable fragment. (A separate Dremel-to-cartridge link does not depend on the fragment.)Unsealed ATF report, April 2026; hearing testimony
Documented
The autopsy was admitted without its author. No medical examiner testified; the defense objected to "an expert report without an expert present" and was overruled. The full report is not public, and where the remaining fragments went has not been accounted for.Hearing record, day 1 · KSL
Open
There was no exit wound. That is documented. What it means is contested: the ordinary explanation, a soft-point round fragmenting on bone, is consistent with the medical examiner's summary and was not rebutted when raised in debate.Medical examiner summary as read Aug 14 2026
Settles itThe full DNA quantitation report; the full autopsy and fragment log; the examiner's bench notes.
The confession, the roommate, and the motive
The pillars of the State's case, and what was never tested.
On the record
The messages' authorship has never been tested. Defense counsel said on the record she had not been given access to her client's phone; the device data sat with the FBI and state investigators; the messages were shown without their timestamps; the judge deferred device discovery.Nester in court, April 2026; Rule 16 filing; bindover record
On the record
The roommate was immunized, recorded, and never cross-examined. He identified the figure by clothing and was "not 100% sure." He also said he and the defendant never discussed Charlie Kirk or LGBTQ issues.Recorded interview played at the hearing
Documented
The defense calls the motive "an inference without evidence." Its brief says there is "no evidence of specific political expressions of Mr. Kirk" the defendant was aware of or focused on. The judge called the defense's argument on the capital aggravator "substantial" and left it for trial.Defense brief, Aug 12 2026; oral argument and ruling, Sept 1 2026
Documented
No parental statement has ever been produced. The "father turned him in" account is an officer's summary of interviews that night; only one of the three people interviewed signed a statement. The defendant has pleaded not guilty to every count.Charging document; hearing record; arraignment, Sept 1 2026
Documented
The defendant is right-handed, per his own filings. Who is holding the phone in the stairwell footage, and in which hand, has not been settled.Court filings; stairwell footage
Settles itA device-level extraction of the messages with account, origin and timestamps; the signed statements from the night of the arrest; one unblurred stairwell frame.
The security and the day
This does not speak to who fired. It speaks to whether the death was preventable, and to accounts of the day that do not agree.
Documented
The university's own planning file shows the event form answered "No" to scheduling EMS, an attendance estimate of 200 then 600 against more than 3,000 who came, six officers, two campus EMTs, and no ambulance.ABC News, Nov 18 2025 (UVU records request)
Documented
The Kirk family now pleads it. Their notice of claim alleges rooftops left unmonitored despite assurances ("I got you covered"), a request for more officers declined, no drone, no written security plan or briefing, no perimeter, no ambulance.Notice of claim, Sept 9 2026 · Deseret News, KSL, CNN

Kirk's September 9 fear message ("I'm somewhat worried the left is trying to kill me" … "I have 11 on site") contradicts his widow's December 11, 2025 statement on Glenn Beck that he sent no such message: "I have his cell phone." Turning Point supplied the screenshots and has never authenticated them. If genuine, they also support the official account's motive.Read on air Aug 14; published c. Aug 23 2026; Glenn Beck Program, Dec 11 2025
On the record
The two men in the back of the SUV give incompatible accounts of the ride. The pastor's account of CPR has narrowed across four statements; the security lead says there was none. The security lead also said Kirk had no fears the night before; the organisation's release says he did.Harpole, Shawn Ryan Show and Paramount Tactical; Turek, four broadcasts
On the record
The "Freedom" shirt was cut off in the vehicle, by the security lead's own account, and does not appear in the court file. The men present changed into hospital scrubs and discarded their clothing.Harpole interview; Turek interview
Open
Kirk was driven to hospital in a private SUV with the hatch open. No 911 call from the vehicle has been produced, and the dispatch log for 12:20–12:40 p.m. has not been released.Accounts on the record; GRAMA target
Settles itThe full notice of claim; UVU's independent review (promised September 2026, unreleased); the authenticated September 9 thread; the CAD log; the hospital's intake record.
The organisation's own record
Statements and conduct from the people closest to the victim that do not hold still.
Documented
One decision, two owners. In November 2025 a Turning Point official defended the absence of an ambulance as covered by its twelve-person team. In September 2026 the family's filing pleads the same absence as the university's negligence.ABC News, Nov 2025; notice of claim, Sept 2026
On the record
The appointment video. The widow introduced the claim that Kirk named her CEO; the organisation's own hosts later said of the contested clip that they "decided… to troll the trolls."Megyn Kelly interview, Nov 2025; The Charlie Kirk Show
Open
The 2019 texts. Screenshots show the spokesman forwarding Owens a troll post that plotted a feud between her and Kirk, and warning her about it, which sits badly with his current account that the two were not friends after 2018. The screenshots come from one party.Displayed Sept 18 2026; wedding attendance is public
Documented
The memorial was held on the campus the family had, the day before, notified of intent to sue.Utah Public Radio, Sept 11 2026; notice of claim
Settles itThe organisation's own communications, which it could publish.
The foreign layer: facts only
Real, documented, and large. None of it is evidence that anyone ordered a killing. That is a separate claim needing separate proof.
Documented
A FARA-registered Israeli influence operation targeted this audience: Clock Tower X registered Sept 18 2025; Show Faith by Works Sept 27 ($3.2M plus $835K, aimed at churches and Christian colleges). Documented
Kirk's own last week: a Sept 9, 3:54 p.m. text saying he was leaving the pro-Israel cause (authenticated by the organisation's spokesman); on-air statements about "moral blackmail"; a Zoom call with Israeli officials the night before.Kolvet video, Oct 7 2025; Megyn Kelly and Shapiro broadcasts
On the record
Joe Kent, former head of the National Counterterrorism Center, resigned saying on camera that the FBI blocked the center from pursuing foreign-involvement leads.Kent, public statements, March 2026
Documented
The New York Times reported Trump "scolded" Kirk over the Epstein files. A FOIA request for the Sept 8–9 Fort Huachuca flight manifest was shelved at queue position ~3,500.NYT; FOIA correspondence
Settles itThe FARA registration statements themselves; the May 2 letter; any agency response to the foreign-involvement leads.
Alleged only
Claims a named source has made that nothing public yet proves. Listed so they can be tested, not believed.
Alleged
That the rooftop screwdriver was planted; that the messages were sent by someone else; that the roommate was a federal asset.Owens broadcasts, July–Sept 2026
Alleged
That a rooftop witness described a .223 and tactical gear; that a 911 open line from the SUV exists with "get that off of him" audible.Recorded interview; unnamed source
Alleged
That the Timpanogos emergency room was cleared two hours before the shooting.Unnamed source; hospital transfer logs would settle it
Alleged
That the SUV was cleaned and resold rather than held as evidence.On-air reporting
Alleged
That the defendant ate at a Panguitch steakhouse that evening. A redacted receipt and a server's account exist; no card match has been shown. One merchant lookup would settle it.Owner and server accounts; Diligent Denizen
Alleged
That a senior French source reported the Foreign Legion on the ground, and that twelve Israeli phones were present that day.Owens; Joe Kent
Alleged
That the microphone was an explosive device.John Bray theory; held by Owens as "a possibility"
Alleged
That security staff who never touched Kirk returned in hospital scrubs; that a hospital doctor asked to be removed from the records.Footage of unstated provenance; unnamed source
Alleged
That the courtroom footage was horizontally squeezed; that "uncompressed" 4K stills show a broader man; that tent clips show the SD card being copied.Owens; unnamed government source
Alleged
That a device fell from George Zinn's leg at his arrest; that the SUV driver handled something at the trunk at 12:11; that a will change was scheduled.Owens broadcasts, Aug–Sept 2026
Settles itEach has a specific record: the evidence log, the dispatch audio, hospital transfer logs, a merchant lookup, booking property records, probate filings, the native exhibits.
What the other side of the ledger still holds.
A fair list has to say this: against every item above stand a message thread that has been stable since September 2025, a handwritten note in the first person, a roommate's recorded account of an admission, extensive DNA across the rifle, a cartridge link to a tool from the defendant's home, and a defense that has so far chosen to contest the death penalty and the standard of proof, not the shot. The documented gaps are real and the prosecution should have to answer for them. Whether they amount to reasonable doubt is a question for the trial.
